Agrigento Court Admits Civil Parties, Defendant Faces Probation Path

Naples/Agrigento, September 23, 2025 — After years of legal proceedings, Daphne Lab has achieved a decisive victory in the protection of its trademarks and proprietary technologies. The Court of Agrigento upheld the compensation claims of Dr. Luigi Di Vaia and Eldavia International Service Soc. Coop., the sole entity authorized to distribute BioMetaTests® and license related trademarks.

The case stemmed from large-scale online sales of counterfeit intolerance tests originating in Agrigento. These products illegally reproduced the logos and trademarks of Daphne Lab®, BioMetaTest®, EcoElia®, and others. Investigations also revealed the fraudulent manipulation of original copyrighted test matrices by inserting new names and pairing them with outdated results belonging to other clients.

The Court issued a direct summons to trial against a naturopath from Agrigento, charged under Article 171-ter of the Copyright Law and Article 473 of the Penal Code (trademark counterfeiting). Daphne Lab and Eldavia joined as civil parties. The defendant requested suspension of the trial with probation under Article 168-bis of the Penal Code. The Judge granted time for submission of a rehabilitation program, which must include measures to repair the harm caused and, where possible, compensate the victims.
